These Terms of Service ("Terms") govern your use of the AI Smart Agents website and services ("Services"), operated by AI Smart Agents ("we," "us," "our"). By accessing our website or engaging our Services, you agree to these Terms.
AI Smart Agents provides website design, content creation, lead-response automation, and unified communications tooling for insurance agencies and related businesses, delivered under the Ignite, Accelerate, or Dominate service tiers as agreed in a separate service order or agreement.
Services are billed monthly at the rate corresponding to your selected tier. Fees are due in advance of each billing period unless otherwise agreed in writing. Engagements are month-to-month with no long-term contract required, and either party may terminate with written notice as specified in your service agreement.
You agree to provide accurate business information, timely feedback, and any access credentials reasonably required for us to perform the Services. Delays in providing this information may delay delivery.
Upon full payment, deliverables created specifically for your account (such as your website and custom content) are licensed for your business use. Underlying tools, templates, frameworks, and automations developed by AI Smart Agents remain our property and may be reused across other clients.
While we design our Services around data-driven best practices, we do not guarantee specific business outcomes, lead volumes, or revenue results, as these depend on factors outside our control.
Our Services may incorporate third-party AI and software tools (including but not limited to Claude and Higgsfield). Your use of outputs from these tools is subject to our reasonable diligence but not a warranty of accuracy or fitness for every purpose.
To the maximum extent permitted by law, AI Smart Agents' total liability for any claim arising from the Services is limited to the fees paid by you in the three (3) months preceding the claim.
Either party may terminate services as specified in your service agreement. Upon termination, outstanding fees for work performed remain due.
We may update these Terms from time to time. Continued use of our website or Services after changes take effect constitutes acceptance of the updated Terms.
